For example, a claimant who suffered a severe back injury with spinal cord and nerve root damage may be compensated between £111,150 and £196,450 for that particular injury alone. Suffering further injuries in the same accident would push this figure up as would any expenses, such as care costs. However, if a claimant suffered a modest ankle injury, such as an undisplaced fracture, they’d be compensated up to £16,770 for the injury and then any related, provable costs, such as lost earnings for a few weeks off work to recover.

    How Much Compensation For Slipping on a Wet Floor Can I Get? 

    The compensation that you will receive for slipping on a wet floor will vary depending on factors such as the severity of the injury sustained, the impact on your enjoyment of life and any expenses that you’ve had to pay. Compensation is therefore split into two heads of claim, known as general damages and special damages. 

    General damages is the compensation awarded to cover the pain that you have suffered during and after your fall. The more serious the injury, the more pain, both mental and physical, you have likely experienced, therefore, the more compensation you will be awarded. 

    To calculate general damages, solicitors and other legal professionals may refer to the Judicial College Guidelines (JCG). The JCG gives a baseline for the amount of compensation awarded for different injuries and severities. For example, the JCG suggests that a back injury sustained from slipping on a wet floor where a disc has been damaged causing severe pain can be awarded up to £85,100. A moderately severe ankle break however, can receive up to £32,450. Both of these figures are according to the JCG. 

     

    The table below gives more examples of how the JCG guides solicitors on how much compensation to award. Please note that these are not the guaranteed amounts of compensation that you will be awarded; they are just a guideline. The first figure was also not taken from the JCG.

    What Factors Will Determine My Wet Floor Slip Compensation? 

    As mentioned above, the factors that will help determine your wet floor slip compensation will include the severity of the injury, the overall prognonsis and recovery time.

    Can Special Damages Be Claimed After Slipping On A Wet Floor? 

    Special damages will also be considered in the compensation for your wet floor slip. So, if you have had to pay any expenses which are associated with the injury that you sustained after slipping on a wet floor, these will be recovered (if you have evidence of them).

    I Was Injured By A Slip On A Wet Floor, Can I Make A Claim? 

    Yes, if you suffered an injury caused by a slip on a wet floor, you can claim compensation. However, you must be able to show that another party had a legal responsibility that they failed to meet, causing you an injury.

    For you to make a compensation claim for slipping on a wet floor, you must be able to prove that you are eligible, and there are several criteria that you must meet for you to prove eligibility. These are detailed below: 

    • Duty Of Care 

    If you want to make a claim for compensation for slipping on a wet floor, you must first be able to prove that you were owed a duty of care by the person or organisation that you are bringing a claim against. This duty is legally expected from the other party. It means that they have to take reasonable steps to prevent injuries from occurring. 

    For example, employers have a legal duty of care for their employees as do occupiers of public spaces. 

    • This Duty Was Breached 

    Once it has been proven that a legal duty of care was owed to you, it must then be proven that this duty of care was breached. A breach can be proven when you show that the party who owed you a duty of care did not take reasonable steps to ensure your health and safety. They may have failed to take reasonable steps by not signposting the wet floor or not efficiently maintaining it. This would therefore prove a breach. 

    • An Injury Was Sustained 

    The final criterion that must be met to prove eligibility for a personal injury claim is proof that an injury or an illness was sustained because of the breach of duty. In order to prove this, you will need evidence such as medical records and statements from a medical professional stating that these health issues were caused by the accident.

    How Might Slipping On A Wet Floor Be A Result of Someone Else’s Negligence? 

    Slipping on a wet floor can be the result of someone else’s negligence if they fail to take reasonable precautions to prevent accidents on a slippery surface. For example, if a floor has recently been mopped, the person or organisation responsible for that space should ensure that a sign is displayed.

    One of the most common causes of a person slipping on a wet floor at the hands of somebody else’s negligence is when someone slips in a public space due to a maintenance issue. This could be because the owner of the vicinity hasn’t signposted a wet floor or ensured that it was cleaned up in a reasonable amount of time. The Occupiers Liability Act 1957 sets out how in a public space such as a pub or a shop, the occupier (person or organisation responsible for the space, such as an owner or manager) has a duty of care towards the members of the public who enter it to take steps to ensure their reasonable safety. Therefore, in an instance such as the examples given above, they would be negligent. 

    The other most common way in which another party has responsibility for someone else slipping on a wet floor is if the accident took place at work. The Health and Safety at Work Act 1974 states that an employer should take all reasonable steps to ensure the safety of his or her employees. So, if you have slipped because of a maintenance issue in the workplace, such as a leaking pipe which was not fixed in a sufficient amount of time, causing you to break your arm, you can make a claim against your employer.
