How Much Nose Injury Compensation Could I Claim?

How much nose injury compensation you could receive following an accident that was not your fault would depend on the severity and pain the injury has caused you, as well as any financial losses. A broken nose is not just painful; it can be really damaging both in terms of impacting your breathing and having a considerable psychological effect. We appreciate that dealing with both the immediate symptoms and ongoing features of a facial injury can be really tricky so we’ve created this guide to claiming nose injury compensation to help you out.

At UK Law, we work with a panel of highly experienced personal injury solicitors who can use their considerable experience to your advantage. These experts in their field can support you throughout the claim process, offering assistance with gathering evidence, negotiating on your behalf and making sure the compensation you are seeking is a fair representation of your losses.

Key Takeaways

  • Your nose is the most prominent feature of your face, so any injury to it can have a substantial impact on your appearance.
  • Facial injuries could occur at work, in public or while on the roads.
  • In addition to the cosmetic effects, an injury to your nose can affect your sense of taste and smell, and accompany concussions and other head injuries.
  • Our panel of solicitors can take on your nose injury claim on a strictly No Win No Fee basis

How Much Nose Injury Compensation Can I Claim?

How much nose injury compensation you could claim will depend on the type and severity of the nose injury you suffered, how this injury has physically and mentally affected you, and whether any financial losses were suffered.

There are two heads of claim under which this compensation may be calculated. These are:

    • General damages: payments for your physical and psychological injuries.
    • Special damages: payments for associated financial harm. We take a more detailed look at special damages in the next section.

In order to determine a potential general damages figure for your claim, solicitors can use your medical evidence alongside the Judicial College Guidelines (JCG). Within this document are guideline brackets of compensation for various injuries, some of which have been used in the following list.

    Compensation Figures

Please be advised that the first figure is not from the JCG and that this information is intended to act as guidance only.

    • Multiple very serious injuries with special damages – including a loss of income, medical bills and psychiatric help. – Up to £250,000 +
    • Moderately severe PTSD – significant disability for the foreseeable future – £28,250 to £73,050
    • Moderately severe general psychiatric damage – significant problems regarding the ability to work and maintain relationships – £23,270 to £66,920
    • Multiple Fractures of Facial Bones – Permanent facial deformities – £18,180 to £29,220
    • Nasal Complex or Nose Fractures (i) – Serious, multiple fractures requiring multiple surgeries with permanent damage to airways – £12,990 to £28,220
    • Nasal Complex Or Nose Fractures (ii) – Displaced fractures requiring surgery – £4,820 to £6,230
    • Nasal Complex Or Nose Fractures (iii) – Displaced fracture requiring manipulation – £3,080 to £3,850
    • Nasal Complex Or Nose Fractures (iv) – Undisplaced fracture with full recovery – £2,080 to £3,080

We stress again that these numbers are intended as guidelines only. For a more personalised idea of what your potential claim could be worth, speak to our advisors today.

What Factors Determine My Nose Injury Payout Amount?

Multiple factors will affect your nose injury compensation payout amount, including the seriousness of the damage and any psychological effects. Factors that influence general damages have been summarised below:

    • Severity: the more serious the damage to your nose, the higher the payout will be. Features such as permanent or temporary disfigurement, breathing difficulties or impacts to taste and smell will all be considered.
    • Psychological effects: Facial injuries can have profound effects on psychiatric and mental health, especially if they are permanent.
    • Loss of amenity: if your injuries prevent you from carrying out daily activities such as hobbies and sports or reduce your quality of life, you could claim for a loss of amenity.

In the next section, we’re going to examine the financial losses you could experience following a nose injury. If you have questions, or would like to know more about making a claim, speak to our advisors today.

What Other Damages Can I Get For An Injured Nose?

Other damages you could get for an injured nose include special damages for the financial losses your injury has caused you to experience. Both past and future losses can be compensated under special damages, so it is very common to see payouts for costs be much higher than those for injuries.

Examples of financial losses that could be reimbursed as part of special damages include:

    • Loss of earnings due to any time taken off work.
    • Loss of future earnings if you remain unable to work, unable to work the same hours or to the same capacity.
    • Medical expenses such as having to pay for corrective surgery for the nose.
    • Prescription fees.
    • Travel expenses to medical appointments.

Make sure you hold onto copies of documents, including travel tickets, purchase receipts, bills and your payslips, as proof of the losses you have sustained.

Can I Claim Compensation For A Nose Injury?

Yes, you could claim compensation for a nose injury if you can demonstrate that the negligent actions of another caused your injury.

    Generally, you need to show:

    • Someone owed you a duty of care (this is a legal responsibility regarding your health and safety)
    • They breached this duty
    • This caused your accident where you suffered your nose injury

Such accidents can occur at work, in public areas or on the roads and we’ll go over these specific instances in the next section.

Examples Of Nose Injuries That May Be Sustained

Some examples of nose injuries that occur are bruises and fractures. Other examples of injuries and symptoms that could be suffered include:

    • Swelling.
    • Soft tissue injuries.
    • Deformity to the cartilage in your nose.
    • Fractures to the nasal or facial bones.
    • Difficulty breathing.
    • Headaches, nausea, loss of vision and vomiting in the event of a head injury.

What Accidents Could Lead To A Nose Being Injured?

Various accidents, including workplace accidents, road traffic collisions and incidents in public areas could lead to your nose being injured. We’ve provided supporting examples for each of these 3 scenarios, with an explanation of who owes a duty of care in each.

    Road Traffic Accidents

All road users, which includes everyone from pedestrians to HGV drivers, must use the roads in a safe manner and do everything possible to avoid harming one another. This means abiding by the laws and rules set down by the Highway Code and the Road Traffic Act 1988.

As an example of how a road traffic accident could lead to a broken nose:

    • You were cycling in a cycle lane along a main road when a driver overshot their turn and swerved into the cycle lane knocking you off your bike and you land face first on the curb of the pavement. Your nose was broken and you suffered serious lacerations to your arm and leg.

    Public Place Accidents

The parties in control of public areas, legally referred to as ‘occupiers’, must take steps to ensure the reasonable safety of any visitors to their premises. This is a legally binding duty under the Occupiers’ Liability Act 1957

An example of an accident that could occur if such steps are not taken could be:

    • A loose carpet tile at the top of a staircase in a showroom had been reported to managers but no steps to conduct a repair had been taken nor was any temporary warning sign placed. When coming towards the stairs, you tripped on the loose tile and fell, breaking your nose and seriously damaging your face.

    Workplace Accidents

Employers are required to take reasonable steps to ensure the safety of their employees while at work according to the Health and Safety at Work etc Act 1974. This can involve measures such as ensuring all work equipment is safe and fit for purpose, and that employees are given the correct training and supervision to do their jobs properly.

A broken nose injury, such as the following, could occur if these steps are not taken:

    • Maintenance checks had not been conducted on workshop machinery, but you had been instructed to use the machines anyway. While you were cutting materials down to size, the saw malfunctioned and a large chunk of wood was launched into your face. You suffered a major break to your nose as well as a serious concussion in the accident.

These examples do not make up an exhaustive list so to get a free eligibility check for your particular circumstances, speak to our advisory team today. We’re available 24 hours a day so whenever you need further advice, we’ll have a team member ready to take your call.

What If My Nose Injury Was A Result Of Medical Negligence?

You could also seek compensation if your nose injury was the result of medical negligence. The duty of care owed by medical professionals is to provide care that meets the correct standards. If these standards aren’t met, and avoidable harm is caused, this is deemed medical negligence.

So, errors in cosmetic or reconstructed surgery that cause breaks to the nasal bones or cartilage, as well as missing clear signs of a broken nose that then worsens considerably could all amount to medical negligence.

To learn about claiming against medical professionals, talk to our team today via the contact details given below.

What If Assault Caused My Nose To Be Injured?

If an assault caused your nose to be injured, you could claim:

    • Against he perpetrator (if you know who they are and that they have the means to compensate you)
    • Against a vicariously liable party (such as your employer if you made them aware a colleague was threatening you and failed to take any steps to ensure your safety)
    • Through the Criminal Injuries Compensation Authority (CICA).

The CICA pays out compensation in line with the Criminal Injuries Compensation Scheme 2012 (CICA Scheme) to the victims of violent crimes. To claim through the CICA you must:

    • Have been injured in a crime of violence, such as an assault.
    • Suffered the injury in Great Britain or another relevant place (such as vessel resisted there)
    • Reported the incident to the police

How Much Criminal Injury Compensation Can I Get For A Nose Injury?

How much criminal injury compensation you could get for a nose injury through the CICA is determined by the tariff of injuries set out within the CICA Scheme. These are fixed amounts, meaning you will receive the exact amount listed for your injury.

We have included some of the figures from the scheme for you here. Please note that the first entry is the maximum amount the CICA will pay for any claim:

    • Multiple very serious injuries with special expenses. – Up to £500,000
    • Total loss of smell and taste – £16,500
    • Loss of smell or taste – £11,000
    • Partial loss of smell, taste or both – £3,500
    • Serious facial disfigurement. – £11,000
    • Significant facial disfigurement – £2,400
    • Depressed skull fracture, surgery required – £4,600
    • Depressed skull fracture, no operation – £2,400
    • Simple skull fracture, surgery required – £3,500
    • Simple skull fracture, no operation – £1,000

You may also be entitled to loss of earnings compensation during a criminal injury claim, although certain eligibility requirements apply. Financial losses resulting from the violent crime can also be compensated as special expenses.

How To Claim Nose Injury Compensation

As part of your claim for nose injury compensation, you will need to collect supporting evidence that demonstrates the severity of the injury you suffered as well as who was liable for it. We have compiled a list of possible evidence you could collect here:

    • Medical records from any treatment you received. Your health is, of course, the first priority, but any scans, tests and examination notes can form part of your evidence.
    • Photograph your injured nose, the surrounding area and the cause of the accident.
    • For an accident at work, documents relating to training or maintenance work can help show shortcomings in health and safety practices.
    • The accident report from the workplace or public place (such as a supermarket) accident book.
    • Footage from CCTV or dash cameras can be a great way to show the accident taking place.
    • Other persons who saw the accident could provide a witness statement. Hand over any relevant contact information to the solicitor so these persons can be reached during the claim.
    • The contact details, vehicle registration number and insurance information if involved in an accident with another driver.

No Win No Fee Compensation For A Nose Injury

Our advisors can tell you within a few minutes if you could be eligible for compensation for a nose injury on a No Win No Fee basis with a solicitor from our panel. If eligible, you’ll put in touch with one of the dedicated personal injury solicitors on our panel of experts.

The solicitors on our panel have worked in personal injury law for years. Those years not only represent considerable experience, knowledge and understanding of legal matters, but form a proven record of winning big for their clients.

A solicitor is not there to simply argue with the defendants on your behalf, but provide a whole range of services, support and legal advice that is built around your particular needs. We are just a few of the things a solicitor from our panel could do for you:

    • Get you the right medical care, counselling and other support you need to cope with your injuries.
    • Supporting you with collecting evidence.
    • Calculating a potential compensation figure for the claim, including any loss of earnings and other special damages.
    • Explaining all the technical legal language and keeping you up to speed on all developments during the claim. We also have a handy legal glossary to help you navigate the tricky terminology.
    • Negotiating a settlement on your behalf with the defendant’s solicitors.
    • Instructing the right barrister for your claim to present the case in court if the dispute proceeds to trial.

    No Win No Fee Solicitors

Our panel can offer eligible claimants some very desirable No Win No Fee terms under a Conditional Fee Agreement (CFA). Claiming under a CFA means you won’t have to pay solicitor fees at the start of or during the claim. There will also be no such fees if the claim is lost.

The Conditional Fee Agreements Order 2013 states that solicitors may charge a success fee, up to a maximum of 25% of the compensation, if the claim is won. As this percentage is legally capped, most of any payout will go to you.
